1. Acceptance of Terms

By accessing and using the website www.ormebikexperience.com, you fully accept these Terms of Service. If you do not agree, please do not use the Site.

2. Services Offered

ORME Bike Experience offers:

• Guided bike tours in Lake Iseo and Franciacorta
• E-bike and bicycle rental
• Bookings via WhatsApp

3. Bookings

3.1 Booking Process

• Contact via WhatsApp: check the Site for the number
• Provide: name, email, phone, dates, number of participants
• You will receive a confirmation within 24 hours
• The booking is binding after your written confirmation

3.2 Cancellations and Refunds

• More than 14 days before: 100% Refund
• 7-14 days before: 50% Refund
• Within 7 days: No refund

Legal notice: Pursuant to art. 59, paragraph 1, letter n) of the Italian Consumer Code (D.Lgs 206/2005) and Directive 2011/83/EU, being contracts for the provision of leisure-related services with a specific execution date, the standard 14-day right of withdrawal is excluded. Therefore, exclusively the cancellation conditions mentioned above apply.

4. Liability

4.1 Participation in Tours

By participating in the tours, you agree that you are in good physical condition, will use safety equipment (helmet is mandatory), and will follow the guide's instructions.

4.2 Exclusions

Except in cases of willful misconduct or gross negligence by ORME Bike Experience, the company is not responsible for:

• Injuries due to reckless behavior or failure to comply with the Highway Code
• Loss of or damage to personal belongings

5. Equipment Rental

5.1 Conditions

• The equipment remains the property of ORME
• You must use it according to the instructions provided
• The helmet is mandatory

5.2 Damages and Theft

• Damages due to negligence: the customer must pay the repair cost
• Theft: the customer is responsible for the full value of the equipment

6. Intellectual Property

All contents of the Site (photos, texts, videos) are the property of ORME. You may not copy them, use them commercially, or claim ownership. You can share them on social media with credit.

7. Applicable Law and Jurisdiction

These Terms are governed by Italian law. For disputes with Consumers, the territorial jurisdiction lies mandatorily with the judge of the place of residence or domicile of the Consumer, if located in the territory of the State (Art. 66-bis Consumer Code). In all other cases and for B2B clients, the exclusive jurisdiction is Brescia.

8. Online Dispute Resolution (ODR)

Pursuant to Regulation (EU) No. 524/2013, we inform Consumers residing in the European Union that the European Commission has established an online platform for alternative dispute resolution (ODR). The platform is accessible at the following link: https://ec.europa.eu/consumers/odr/.
